Terms of Service

1. GENERAL PROVISIONS.

1.1.

These Terms of Service set out the rules and conditions for using the GrowKido website available at growkido.pl (hereinafter the "Service").

1.2.

The owner and operator of the Service is Inizio Studio Kamil Dobek, with its registered office at ul. Niedziałkowskiego 17/9, 71-403 Szczecin, Poland, Tax ID (NIP): 8513339937, email address: [email protected], hereinafter referred to as the "Service Provider" or "GrowKido".

1.3.

GrowKido is an information and directory platform whose purpose is to connect parents looking for children's activities with the organizers of such activities. The Service Provider is not a party to any agreements concluded between Users and Organizers outside the Service.

1.4.

Use of the Service constitutes acceptance of these Terms. Persons who do not accept the Terms should immediately stop using the Service.

1.5.

The Terms are made available free of charge at growkido.pl in a form that allows them to be downloaded, stored and printed.

2. DEFINITIONS.

The terms used in these Terms of Service have the following meaning:

2.1.

Service - the online platform available at growkido.pl, used to present and search for children's activities.

2.2.

Service Provider / GrowKido - the entity operating the Service, referred to in section 1.2.

2.3.

User - any natural person who uses the Service, in particular by browsing organizer profiles or searching for children's activities. The User may use the Service without registering or after creating a User Account.

2.4.

User Account - a voluntary, free account of a parent or guardian in the Service, enabling the use of features such as a favorites list and (in the future) submitting reviews about Organizers.

2.5.

Organizer - an entity (a natural person conducting business activity, a legal person or another entity) holding an Organizer Account in the Service and presenting an offer of children's activities through a Profile.

2.6.

Organizer Account - the Organizer's individual administrative panel, available after registration and verification, enabling the management of the Profile.

2.7.

Profile - the Organizer's presentation page in the Service containing information about the children's activities they provide.

2.8.

Favorites - a feature available to registered Users that allows them to save selected Organizer Profiles to a private list within the User Account.

2.9.

Review - a voluntary, subjective rating or comment posted by a registered User regarding a given Organizer's activities. The review feature is planned and will be made available in a future version of the Service.

2.10.

Free Services - services provided by GrowKido free of charge, in particular the maintenance and presentation of an Organizer's basic Profile and the User Account together with the Favorites feature.

2.11.

Paid Services - optional services for increased visibility or other additional services, the detailed rules of which are set out in a separate Paid Services Terms document available at growkido.pl/regulamin-platny.

2.12.

Children's Activities - organized forms of activity, education, sport, culture, recreation or entertainment aimed at children and young people up to 18 years of age.

3. TYPE AND SCOPE OF ELECTRONIC SERVICES.

3.1.

Through the Service, GrowKido provides the following electronic services:

3.1.1.

a search engine for children's activities with filtering by category, age, district and locality;

3.1.2.

presentation of the Organizer's Profile, containing a description of the activities, contact details, schedule and pricing;

3.1.3.

a contact form allowing Users to contact the Organizer directly;

3.1.4.

Organizer Account - a Profile management panel, available after registration and verification;

3.1.5.

User Account - a voluntary parent or guardian account enabling the use of the Favorites feature;

3.1.6.

Favorites - a feature for saving selected Organizer Profiles to a private list within the User Account;

3.1.7.

Reviews - a planned feature for posting ratings and comments by registered Users; detailed rules will be published before its launch;

3.1.8.

newsletter sign-up (optional);

3.1.9.

optional Paid Services - on the terms set out in the Paid Services Terms.

3.2.

Use of the Service by Users (parents) is and will remain free of charge, regardless of whether the User has an Account or uses the Service without registering.

3.3.

The Organizer's basic Profile is free of charge indefinitely. The free nature of the basic profile is an element of the Service's business model and not a temporary promotion.

3.4.

An agreement for the provision of services by electronic means is concluded upon successful completion of Account registration (for Organizers and Users registering in the Service) or upon starting to use the Service (for Users without an Account).

3.5.

The agreement for the provision of services by electronic means is terminated upon deletion of the Account by the Organizer or User, or by GrowKido in the cases provided for in these Terms.

3.6.

Technical requirements necessary to use the Service: a device with Internet access, an up-to-date web browser (Chrome, Firefox, Safari, Edge - in a version released no earlier than 3 years before the date of use), cookies and JavaScript enabled. GrowKido does not guarantee full functionality of the Service in older browsers or with JavaScript disabled.

4. CONDITIONS FOR REGISTERING AND MAINTAINING AN ORGANIZER ACCOUNT.

4.1.

An Organizer Account may only be created by an entity that:

4.1.1.

conducts or organizes children's activities within the meaning of the definition contained in section 2 of these Terms;

4.1.2.

conducts legal business activity and holds all permits, notifications or certificates required by law to conduct the given type of activities (if such are required);

4.1.3.

has consented to the provisions of these Terms.

4.2.

Account registration takes place via:

4.2.1.

completing the registration form available in the Service, or

4.2.2.

taking over a pre-created Profile prepared by GrowKido on the basis of publicly available data, after email verification.

4.3.

The Organizer undertakes to provide true, current and complete data during registration and to keep them up to date. Providing untrue data is grounds for deletion of the Account.

4.4.

The Organizer undertakes to keep the Account access data confidential and is responsible for actions taken using their login credentials.

4.5.

One Account may be assigned to one entity. GrowKido reserves the right to verify the Organizer's identity. The Organizer Account may not be transferred to another entity without the prior written consent of GrowKido. In the event of a business takeover (e.g. sale of a school), the new owner is required to set up a new Account.

4.6.

GrowKido may suspend an Organizer Account while a breach is being clarified, instead of deleting it immediately, if the breach is not gross. Suspension means hiding the Profile from search results while preserving access to the panel. GrowKido will inform the Organizer of suspension by email without undue delay.

4.7.

After deletion of an Organizer Account, GrowKido may retain the Profile in archival form (without contact details) for up to 12 months for statistical purposes and to handle any complaints and claims. After that period, the Profile is permanently deleted or anonymized.

4a. CONDITIONS FOR REGISTERING AND MAINTAINING A USER ACCOUNT (PARENT).

4a.1.

A User Account may only be created by an adult natural person (who has reached the age of 18), in particular a parent or legal guardian of a child, who has provided true and current data during registration and accepted the provisions of these Terms. Registration by persons under the age of 16 is not permitted. Persons aged 16-17 may use the Service without registering an Account.

4a.2.

Registration of a User Account is voluntary and free of charge. Users without an Account may use the search engine and browse Profiles without restriction.

4a.3.

A User Account enables:

4a.3.1.

saving selected Organizer Profiles to the Favorites list;

4a.3.2.

posting Reviews about Organizers - once this feature is launched;

4a.3.3.

managing notification and newsletter settings.

4a.4.

The User undertakes to keep the Account access data confidential and is responsible for actions taken using their login credentials. The Account is assigned to a specific person and may not be transferred to another entity or shared with third parties.

4a.5.

The User may delete their Account at any time via the settings panel or by contacting GrowKido at [email protected]. Deletion of the Account results in the permanent deletion of the Favorites list and all submitted Reviews. GrowKido may retain anonymized statistical data.

4a.6.

GrowKido may suspend or delete a User Account if the User breaches the provisions of these Terms, in particular by submitting Reviews contrary to section 8.4, or by taking actions that disrupt the operation of the Service. Suspension precedes deletion unless the breach is gross.

5. REQUIREMENTS FOR PROFILE CONTENT.

5.1.

The Organizer's Profile must relate exclusively to children's activities provided by that Organizer within the meaning of section 2 of the Terms. The Profile may not be used to promote other entities, products or services not directly related to the Organizer's offer of children's activities.

5.2.

The Organizer undertakes that all content placed on the Profile will be:

5.2.1.

true, reliable and current;

5.2.2.

consistent with the Organizer's actual offer of activities;

5.2.3.

compliant with applicable law and good morals;

5.2.4.

non-infringing of third-party rights, including copyright, image rights and personal rights;

5.2.5.

free from unlawful, offensive, discriminatory or harmful content.

5.3.

In the Profile content, activity descriptions, communications and graphic materials, it is prohibited in particular to:

5.3.1.

post advertising content of third parties unrelated to the Organizer's activity in the field of children's activities;

5.3.2.

place affiliate links, discount codes or promotional materials concerning entities other than the Organizer;

5.3.3.

promote services aimed exclusively at adults;

5.3.4.

provide information about activities that the Organizer does not actually conduct;

5.3.5.

use the Profile as a distribution channel for marketing content unrelated to the Organizer's children's activities;

5.3.6.

post personal data of third parties without their consent;

5.3.7.

post content infringing legal provisions, in particular on personal data protection, copyright or unfair competition.

5.4.

Graphic materials (photos, videos, graphics) placed on the Profile must relate to the Organizer's activity in the field of children's activities.

5.5.

By submitting graphic materials to the Profile, the Organizer declares and warrants that:

5.5.1.

they are the sole rights holder or hold a valid license, the consent of the rights holder or another legal basis enabling publication of the given material on the Internet for commercial purposes;

5.5.2.

the materials do not infringe copyright, image rights, industrial property rights or any other rights of third parties;

5.5.3.

in the case of photographs featuring people's image - they hold the persons' written consent to publication of their image, and in the case of minors - the consent of their parents or legal guardians.

5.6.

GrowKido does not verify the Organizer's legal title to the graphic materials posted and bears no liability for infringements of copyright or other rights of third parties resulting from materials published by the Organizer. The Organizer bears sole responsibility in this regard.

5.7.

If a third party (including a collective rights management organization, photo agency or photographer) brings a claim, demand, lawsuit or other proceedings against GrowKido in connection with materials posted by the Organizer, the Organizer undertakes to:

5.7.1.

immediately take over the dispute or participate in it at GrowKido's request;

5.7.2.

release GrowKido from any liability in this respect;

5.7.3.

indemnify GrowKido for all damages, including legal costs, incurred in connection with such a claim.

6. CONTENT MODERATION, REPORTING VIOLATIONS AND GROWKIDO'S RIGHTS.

6.1.

GrowKido reserves the right to monitor content posted in the Service in order to verify its compliance with these Terms.

6.2.

Any User and Organizer may report to GrowKido content that breaches the Terms or applicable law (reporting form available in the Service or message to [email protected]). The report should include: identification of the specific content (link or description), a description of the breach and the reporter's contact details. GrowKido reviews reports within 7 business days and informs the reporter of the decision taken.

6.3.

GrowKido is entitled to remove, hide or block content or an entire Profile that:

6.3.1.

does not meet the thematic requirements of the Service (relates to activities other than children's activities);

6.3.2.

contains prohibited content referred to in section 5.3;

6.3.3.

contains false or misleading information;

6.3.4.

infringes applicable law or third-party rights;

6.3.5.

is used in a manner inconsistent with the purpose of the Service.

6.4.

If a breach is identified, GrowKido may:

6.4.1.

call on the Organizer to remedy the breach within 48 hours, sending the request to the email address linked to the Account;

6.4.2.

suspend the Account pending clarification (hiding the Profile without data loss);

6.4.3.

in the absence of a response or in the case of gross breach - delete the Profile or Account without prior notice.

6.5.

The Organizer may appeal against the decision to remove or suspend the Profile or Account within 14 days of receiving the information, by sending a message to [email protected]. GrowKido will consider the appeal within 14 business days and inform the Organizer of the outcome.

6.6.

GrowKido is not liable for content posted by Organizers or for Reviews posted by Users. The Organizer bears sole responsibility for the content of their Profile. The User bears sole responsibility for the content of any Review they post.

6.7.

With regard to Reviews (once the feature is launched), GrowKido reserves the right to remove a Review which:

6.7.1.

breaches the prohibitions referred to in section 8.4 of these Terms;

6.7.2.

originates from a User Account registered solely to post that Review or from Accounts showing coordinated activity;

6.7.3.

has been considered by GrowKido, upon a substantiated report by the Organizer, to be inconsistent with the Terms.

6.8.

The Organizer may appeal against a decision to leave a Review in place, by sending a report to [email protected]. GrowKido reviews such reports within 14 business days.

7. GROWKIDO'S LIABILITY.

7.1.

GrowKido provides services consisting of making available a platform enabling the presentation of offers of children's activities. GrowKido is not an organizer of, nor a party to, any agreements regarding activities concluded between Users and Organizers.

7.2.

GrowKido does not verify the professional qualifications of those conducting the activities, the technical condition of the facilities, the up-to-date status of the offer or the quality of the activities provided.

7.3.

GrowKido is not liable for:

7.3.1.

content posted by Organizers on their Profiles;

7.3.2.

the quality, safety or legality of activities presented in the Service;

7.3.3.

damages resulting from the User's use of the Organizer's services;

7.3.4.

unavailability of the Service due to reasons beyond GrowKido's control, in particular resulting from network or technical infrastructure failures;

7.3.5.

the consequences of Users' or Organizers' actions contrary to the Terms.

7.4.

GrowKido makes every effort to ensure that the Service operates continuously and uninterruptedly, but does not guarantee one hundred percent availability of the Service. GrowKido reserves the right to technical breaks.

8. RIGHTS AND OBLIGATIONS OF THE USER.

8.1.

The User uses the Service voluntarily and free of charge, regardless of whether they hold a User Account.

8.2.

The User undertakes to:

8.2.1.

use the Service in accordance with its intended purpose and the provisions of the Terms;

8.2.2.

refrain from actions that could disrupt the proper functioning of the Service, in particular not to use automated tools for mass data collection (web scraping) without GrowKido's consent;

8.2.3.

not post in contact forms or other places in the Service any content that is unlawful or infringes third-party rights.

8.3.

Favorites feature:

8.3.1.

The Favorites list is private and visible only to the logged-in User.

8.3.2.

Deletion of the User Account causes permanent removal of the Favorites list.

8.3.3.

GrowKido may use aggregated, anonymized data about saved Favorites solely for statistical purposes and to improve the Service.

8.4.

Reviews feature (planned):

8.4.1.

Reviews may only be posted by registered Users holding a User Account.

8.4.2.

A Review must be reliable, truthful and based on the User's personal experience with the given Organizer or their activities.

8.4.3.

It is prohibited to post fictitious, sponsored or coordinated collective Reviews (so-called fake reviews) or Reviews aimed at unfairly lowering the Organizer's reputation.

8.4.4.

It is prohibited to post in Reviews any unlawful, offensive, discriminatory content or content infringing the personal rights of the Organizer or third parties.

8.4.5.

GrowKido reserves the right to remove a Review that breaches the Terms. The Organizer may report Reviews for verification via the form available in the Service.

8.4.6.

Detailed rules for posting Reviews, including the procedure for their verification and removal, will be published before this feature is launched.

8.5.

Any complaints regarding the quality or correctness of the activities provided shall be addressed by the User directly to the Organizer.

9. PAID SERVICES.

9.1.

In addition to the free basic Profile, GrowKido offers optional Paid Services, including in particular highlighting the Profile in search results and category priority.

9.2.

Paid Services are voluntary. Not purchasing Paid Services does not affect the availability or functionality of the free basic Profile.

9.3.

The detailed conditions, scope, pricing and rules of use of the Paid Services are set out in a separate document - the GrowKido Paid Services Terms, available at growkido.pl/regulamin-platny.

9.4.

GrowKido reserves the right to expand, modify or withdraw the offer of Paid Services while maintaining the principle that the basic Profile remains free.

9a. RIGHT OF WITHDRAWAL FROM THE AGREEMENT.

9a.1.

A User who is a consumer and has concluded an agreement for the provision of services by electronic means (including registering an Account) has the right to withdraw from that agreement without giving any reason within 14 days of its conclusion, by sending a statement to [email protected].

9a.2.

The right of withdrawal does not apply to services that have been fully performed with the consumer's express consent, where the consumer was informed before the performance began that, upon performance, they would lose the right of withdrawal. Use of the Service (browsing results, using the Favorites feature) constitutes such full performance of the service.

9a.3.

For Paid Services, the right of withdrawal and its exclusions are governed by the Paid Services Terms.

10. PERSONAL DATA PROTECTION.

10.1.

The controller of the personal data of Users and Organizers is the Service Provider referred to in section 1.2.

10.2.

The rules for processing personal data, the rights of data subjects and information on cookies are set out in the Privacy Policy available at growkido.pl/polityka-prywatnosci.

10.3.

By using the Service, the User and Organizer confirm that they have read the Privacy Policy.

11. COMPLAINTS.

11.1.

Complaints regarding the operation of the Service or the manner of providing services by GrowKido may be submitted:

11.1.1.

electronically to: [email protected];

11.1.2.

in writing to the registered office of the Service Provider referred to in section 1.2.

11.2.

The complaint should contain: the first name and surname or name of the complainant, email address, description of the subject of the complaint and the expected manner of its resolution.

11.3.

GrowKido reviews complaints within 14 business days of receipt. The reply is sent to the email address indicated in the complaint.

11.4.

Consumers have the right to use out-of-court dispute resolution mechanisms, in particular via the ODR platform available at: https://ec.europa.eu/consumers/odr.

12. INTELLECTUAL PROPERTY.

12.1.

All rights to the Service, including its graphic design, source code, name and the GrowKido logo, belong to the Service Provider or to entities to which the Service Provider has been granted appropriate licenses.

12.2.

Use of materials available in the Service without the consent of the Service Provider, beyond permitted personal use, is prohibited.

12.3.

By placing content and graphic materials on the Profile, the Organizer grants GrowKido a non-exclusive, free license to present them in the Service and in the Service's promotional materials (e.g. social media, newsletters) for the purpose of promoting the Service and the Organizer's offer. The license expires when the relevant materials are removed from the Profile or the Account is deleted.

13. CHANGES TO THE TERMS.

13.1.

GrowKido reserves the right to amend these Terms for important reasons, in particular in the event of changes to legal provisions, changes to the scope or manner of providing services, or for technical or organizational reasons.

13.2.

GrowKido will notify Organizers and registered Users of any change to the Terms at least 14 days in advance, by sending a message to the email address assigned to the Account and by publishing the new version of the Terms in the Service.

13.3.

An Organizer or User who does not accept the changes may delete their Account within 14 days of receiving the notification. Continued use of the Service after that period means acceptance of the amended Terms.

13.4.

Changes affecting only Users without an Account take effect on the date of their publication in the Service.

14. FINAL PROVISIONS.

14.1.

These Terms enter into force on 21.05.2026.

14.2.

In matters not regulated by these Terms, the provisions of Polish law apply, in particular the Civil Code, the Act of 18 July 2002 on the provision of services by electronic means and the Act of 30 May 2014 on consumer rights.

14.3.

The law governing relationships arising from these Terms is Polish law.

14.4.

Disputes arising from use of the Service are resolved by the court having local and subject-matter jurisdiction in accordance with the provisions of the Code of Civil Procedure. For consumers, the competent court is the court of the consumer's place of residence.

14.5.

The titles of the sections are for informational purposes only and do not affect the interpretation of the provisions of the Terms.

14.6.

If any provision of the Terms turns out to be invalid or ineffective, the remaining provisions shall remain binding.
